The United States Department of Labor (DOL) has just released the finalized Family Medical Leave Act (FMLA) regulations, which take effect on January 16, 2009.
New Rx: Limited Overtime In Health Care
The General Assembly recently passed, and Governor Rendell has just signed a bill into law, which will prohibit mandatory overtime for nurses, except in very limited situations.
I-9 Update
Recently DHS rolled out a Form I-9 that expires June 30, 2009. No modifications have been made to the form within the past year. Employers should discard prior revisions and begin to use the updated form immediately.
"Clean Indoor Air Act" Update
On June 13, 2008, the Governor signed SB 246 into law, the new Clean Indoor Air Act, which will take effect in 90 days.
Extension of Unemployment Compensation Benefits Announced
On July 1, 2008, Governor Rendell announced the start of Emergency Unemployment Compensation benefits (EB). EB provides up to an additional thirteen (13) weeks of benefits to employees. There is no charge to employers for EB.

"No Match" Update
In our September 2007 E-Alert, we informed you of the new HR buzz phrase "No Match" where employers are informed by the Social Security Administration (SSA) or the Department of Homeland Security (DHS) that the name and social security number (SSN) offered by an existing employee or applicant does not match the information on file with those agencies.
FMLA Proposed Regulations
On February 11, 2008, the Department of Labor (DOL) published proposed regulations updating the Family Medical Leave Act (FMLA) in the Federal Register and requested comments. All comments must be received on or before April 11, 2008.
FMLA Expanded to Include Military Family Leave
Effective January 28, 2008, the Family and Medical Leave Act ("FMLA") has been expanded by the National Defense Authorization Act for FY 2008 ("NDAA"), Pub. L. 110-181. NDAA authorizes expanded leave to employees of a "covered employer," generally a governmental agency or an employer with fifty or more employees, to care for an injured servicemember.
