New Poster Required For NLRA
Effective on November 14, 2011, almost all private sector employers will be required to post information concerning the National Labor Relations Act (NLRA) administered by the National Labor Relations Board (NLRB) on bulletin boards and inter and intranet sites, if customarily used for human resources information.
Such a posting is already required by the Department of Labor's Office of Federal Contract Compliance (OFCCP) for federal contractors.
Posters are available from the NLRB's website and its Regional Offices in English and other languages. The poster must be at least 11 x 17 inches.
Copies of the current OFCCP poster can be obtained from http://www.dol.gov/olms/regs/compliance/EmployeeRightsPoster11x17_Final.pdf.
Copies of the new poster can be obtained from http://www.nlrb.gov/news/nlrb-poster-employee-rights-now-available-download.
The NLRB believes that many employees, including immigrant workers, protected by the NLRA are unaware of their rights under the NLRA, and that the rule will increase knowledge of the NLRA among employees. This will allow better exercise of their rights under the NLRA.
The poster is the NLRB's response to this perceived problem.
Posting will be required 75 days after posting of the final rule making, which was published on August 30, 2011 in the Federal Register.
Anyone seeking additional information on the background for the rule making can consult the NLRB's 194 page explanation and filing in the Federal Register.
