I-9 Update
In our November 2007 E-Alert, we informed you of the updated Form I-9, Employment Eligibility Verification that was issued by the Department of Homeland Security, U.S. Citizenship and Immigration Services (DHS). However, this form expired on June 30, 2008.
Recently DHS rolled out a Form I-9 that expires June 30, 2009. No modifications have been made to the form within the past year. Employers should discard prior revisions and begin to use the updated form immediately.
We have included the new Form I-9 link for your convenience. Click on the link below and look for the New I-9 form at the bottom of the webpage (http://www.uscis.gov/i-9).
Just as a reminder, it is the EMPLOYER'S responsibility to ensure Section 1 is completed at the time of hire, which is the actual beginning of employment. Within three (3) business days from the date employment begins, the employer must review documents presented and complete Section 2.
BOTTOM LINE: Employers should use the updated I-9 form immediately. Remember, employers have the responsibility for completing and retaining the I-9 forms. These forms should be kept separate and apart from the employee's regular personnel file.
